good afternoon. tori campbell has the afternoon off. a transit bus collided with a car. i'm mike mibach. we are live with sal castaneda. police are trying to figure out who is at fault. >> reporter: they have saying the -- are saying that the car did run this stop sign. you can see cars drive by

pretty fast here. the bus ended up on that hill here. i want to show you the bus ton wrong side of the embankment. a driver was traveling on a side street and he ran a stop sign and was hit by the bus which did not have a stop sign. that bus was on davidson. it occurred right in the middle of the intersection. >> the driver was ejected from his car. he was pronounced deceased at the scene here. the bus driver is uninjured. five passengers suffered minor injuries. they were transported to local hospitals. >> reporter: it is hard to look at the damage of the small car which is unrecognizable. it happened at about 5:45. it was still dark.

people who live in the neighborhood tell me traffic is dangerous because traffic gets going pretty food. the speed limit is 35 miles per hour. it is not controlled bay stop sign. they say people routinely speed. they wonder if more police patrols could force people to slow down. >> before we had a shortage of police officers this was pretty well patrolled for speed. they would sit right here at this intersection and pull people over. we don't see much of that anymore. they need to hire more officers and help handle that problem. >> reporter: i was standing on berwood here. they going pretty fast, about 35 is just a suggestion to some who drive here. say lot of people say there have been a lot of accidents. this morning this accident took

a man's life. let's go back to you in the studio. >> all right. thank you. a mother and her one-year- old son remain in critical condition after they were hit by an suv while crossing the street in haywood last night. they say the mother was pushing her infant son when an suv hit them. the woman who hit them stayed at the scene and they don't think she was under the influence. a witness says he saw the baby boy still strapped in his stroller after being struck. the man speaks only spanish. >> i had never seen anything like this. i had trouble sleeping thinking ability the little boy -- about the little boy and young woman. >> they tell us it's dangerous because vehicles are speeding up and there's no stop of traffic there.

the chp try to go figure out whether speed was a factor in this crash. investigators say they will be looking at whether the time of day and setting son may have contributed to the accident. one of the men accused of a shooting death occurred. anthony sims is faces murder and various weapons charges. he did not enter a plea. they say he admitted to being involved in a shoot out. a 30-year-old woman was try to go get her kids to safety when she was hit bay stray bullet. her mother spoke briefly after the court hearing. >> i pray for her family and everything. i give them my condolences for her children. i know how i feel. i have grandchildren and everything and children myself. so i apologize on their behalf. god bless them.

>> earlier this week two other men were also charged with murder. police say it's not clear who fired the fatal shot. the investigation is ongoing. jerry brown announced a proposal to spend more than $1 billion for drought relief. we are live now from the news room with the latest developments. >> they say some critics wonder is this really enough. 93% of the state in severe or emergency drought conditions the legislature seems ready to do something. >> we have to be more efficient and if the drought continues we'll have to be incredibly innovative to keep our current lifestyle. >> reporter: init colludes money for aggressive ground water management.

latest isis claim. we have more on the investigation into the attack. they have identified the gunmen killed in yesterday's museum attack. this morning they arrested nine more suspects. they say the gunman could be among those who have left to be trained by terror group. some of them have come back to stage attacks on their home soil. >> they are in a situation of being lone wolves. there are few operations that are lead or demanded by their superiors >> this morning the first lady offered condolences on behalf of herself and president obama. >> our hearts go out to the loved ones of those who were lost here in japan and around the world. they are very much in our thoughts and prayers today. >> in the streets residents staged a vigil in solidarity

issues. >> reporter: jennifer is the chief operating officer. she is overseeing redevelopment plans and the main street neighborhood which includes these buildings. >> how have those been allowed to stand all these years? >> right. it's a 900-acre property. there are a number of resources, buildings out there that are vacant. >> reporter: she said alameda paid half a million dollars to demolish 12 buildings like these but insists the city doesn't have the money to tear down the remaining ones still barely standing. >> reporter: if we were talk about a private owner of those properties wouldn't those buildings be red tagged and forced to take action? >> we have confirmed with the fences that they have up that they are not an eminent threat. >> reporter: we are talking about years and yearsover being in disrepair.

and so is hayward. it is 53. okay. 56 san francisco. it probably helped the fog a little bit. maybe you can keep the temperatures a little cooler. they have been way too warm to be honest for you. it is getting warm throughout the stay. 70s fresno and 60s down south. i'll show you this in just a second. we'll get a cool down late friday into saturday. it won't bring any rain. it will bring increase in fog. tough day down in phoenix. it is churning around and a lot of thunderstorm cells developing rapidly. a lot of cloud cover and some of that has moved back in. it looks like it is just now clipping san diego. it is around palm springs to l.a . thunderstorm activity and rain. it is sunny and mild to warm. it is very warm for some. a few high clouds but upper 70s

the dow jones is down triple digits, 121 and 122. the nasdaq was up about 14 points. apple stock is getting a little extra attention. this morning the tech giant made the debut. it replaced at&t. apple is the biggest company in the u.s. but it wasn't part of the dow because the stock was

too expensive. after a recent stock split the shares sell for $128. it is the sixth most expensive stock on the dow. a federal court will consider a an agreement to pay a $10 million settlement. target has said at least 40 million credit cards were compromised in the breach during the 2014 holiday shopping season. it would also require to put in data security measures like appointing a chief information security officer. starbucks pushes after backlash. the ceo is encouraging them to write race together on the coffee cups. he is hoping to start a dialogue. many say starbucks is not in the right place to talk about this issues. some customers had differing
